A K-1 Visa, also called the Fiance Visa, is a 90-day visa that allows a foreign fiancee of a US Citizen entry into the United States to get married.  The K-1 Visa allows for a single entry, which means you must get married during the 90-day period after the fiance enters the U.S. for the first time under this visa.

The K-1 visa process is extremely complicated, and the application itself is detailed and full of tricks.  It is quite easy to make mistakes that are then difficult, if not impossible, to correct later.  Fortunately, if done properly, the K-1 visa application is usually the easiest and fastest way to bring a fiance here to marry and immigrate to the U.S.

The basis requirements for the K-1 visa are:

    1. The U.S. citizen petitioner and foreign fiancée must be free to marry.

    2. The U.S. citizen petitioner and foreign fiancée must have met in person within the last 2 years before filing for the fiancée visa. This requirement is waivable in circumstances involving violation of long-established customs, or if meeting would create an extreme hardship to the U.S. citizen petitioner.

    3. The U.S. citizen petitioner and foreign fiancée must marry within 90 days of the fiancée entering the U.S.

    4. The U.S. citizen petitioner may apply to bring the foreign fiancées unmarried children under 21 years old.
